PlayGeet Private Limited (“PlayGeet”, “Company”, “we”, “us”, or “our”), a company having its registered office at 3rd Floor, JMD Regent Arcade, A-Block, DLF Phase-1, Sector-28, Gurugram, Haryana 122002, India, operates the OwnBeat platform at https://www.ownbeat.co and all related applications and services (collectively, the “Platform”). We are committed to protecting the privacy of every person who uses our Platform, and this Privacy Policy explains what personal information we collect, how we use it, with whom we share it, and the rights you have over it.
This Privacy Policy should be read alongside our Terms and Conditions of Use. By accessing or using the Platform, you consent to the collection, processing, and use of your information as described in this Policy. If you do not agree, please do not use the Platform.
We may update this Policy from time to time. Material changes will be prominently communicated on the Platform. Continued use of the Platform after any update constitutes acceptance of the revised Policy.
1Information We Collect
We collect two broad categories of information:
Personally Identifiable Information (“PII”): Information that can be used to identify you individually. This includes — but is not limited to — your name, age, email address, billing and delivery address, IP address, payment details, usage preferences, and any other data you provide when you register an account, purchase Content, submit or post material, or communicate with us.
Aggregate / Non-Personal Information: Data that does not, on its own, identify a specific individual. This includes referring and exit URLs, browser type, IP address (used non-personally for diagnostics), and general patterns of how users navigate and use the Platform. This data is used in aggregate form to understand and improve the Platform.
2How We Collect Information
We collect information only when you voluntarily provide it or when it is generated automatically by your interaction with the Platform. Collection occurs:
- (a) when you visit the Platform or create an account;
- (b) when you browse the Platform or open or respond to any email we send you;
- (c) when you contact us with a query or support request;
- (d) when you link your account to a social media or third-party platform — by doing so you authorise those platforms to share relevant account information with us, which we handle in accordance with this Policy;
- (e) automatically through cookies, web beacons, and similar tracking technologies;
- (f) through your device — including non-personal details such as device type, IP address, geo-location identifiers (at city/region level), unique device identifiers, browser type, and language, used to personalise your experience; and
- (g) through location data if you enable GPS or location services on your device or browser.
3Third-Party Platform Integrations
You may connect your YouTube channel to your OwnBeat account. When you do so, we access certain YouTube channel data — such as your channel ID — via the YouTube Data API Services. We store your channel ID for licensing purposes (for example, to register your channel for Content ID). We may share your channel ID with our authorised Content ID licensing partners.
By connecting a YouTube account, you also agree to Google’s Privacy Policy (http://www.google.com/policies/privacy). You can revoke our access to your YouTube data at any time through your Google security settings at https://security.google.com/settings/security/permissions. When you disconnect your YouTube channel from the Platform, we delete the associated stored data.
We also use your PII and aggregate data to operate, improve, and market the Platform, to fulfil purchases and subscriptions, to communicate important notices, and to enforce our Terms. We may use your IP address for server diagnostics and demographic analysis.
4How We Use Your Information
We process your information for the following purposes:
- (a) to operate the Platform, process transactions, and fulfil subscriptions and purchases;
- (b) to improve the Platform’s features, content, and user interface through statistical analysis of usage patterns;
- (c) to send you marketing communications, offers, product updates, and general information about the Platform and affiliated services — you may opt out of commercial emails by following the unsubscribe instructions in those messages;
- (d) to authenticate users and match them to their authorised accounts;
- (e) to perform our contractual obligations to you;
- (f) to resolve disputes, investigate complaints, and enforce our Terms and this Policy;
- (g) to process service requests and respond to your queries;
- (h) to diagnose technical problems, maintain server security, and gather aggregate demographic statistics;
- (i) to administer any contests, promotions, or loyalty programmes we run; and
- (j) to protect the legal rights, safety, and property of the Company, its employees, and users, and to comply with applicable law.
5Data Retention
We retain your PII for as long as necessary to fulfil the purposes described in this Policy, or as required by applicable law. We may also retain information for legitimate business purposes such as analytics, fraud prevention, and dispute resolution. When retention is no longer required, we will securely delete or anonymise your data.
6Cookies and Similar Technologies
We use cookies — small text files placed on your device — and similar technologies such as web beacons and local storage to make the Platform work correctly, to remember your preferences, and to understand how users interact with the Platform.
Types of cookies we use:
- Essential cookies: necessary for the Platform to function (e.g., session management, login state).
- Analytical / performance cookies: help us understand usage patterns (e.g., Google Analytics).
- Targeting cookies: used to deliver relevant advertising and content.
Third-party service providers (such as analytics vendors or advertisers) may place their own cookies on your device. We do not control those cookies.
We also use local storage (“localStorage”) to maintain your login state across sessions. This data is not accessible to third parties.
You can control cookies through your browser settings. Disabling essential cookies may affect Platform functionality. Opting out of analytical or targeting cookies will not prevent you from using the Platform, but will reduce our ability to personalise your experience.
7Sharing and Disclosure of Information
We work with trusted third-party service providers (“Service Partners”) — such as payment processors, cloud infrastructure providers, analytics vendors, and content delivery networks — to operate and improve the Platform. We share only the PII that Service Partners need to perform their services. We contractually require them not to use your PII for any purpose other than the services they provide to us. However, the data practices of Service Partners are governed by their own privacy policies, and the Company cannot guarantee their compliance.
We may also disclose PII:
- (a) when required by law, court order, executive directive, or law enforcement request;
- (b) to protect the rights, property, or safety of the Company, its users, or the public;
- (c) to our affiliates and subsidiaries for purposes consistent with this Policy;
- (d) in connection with a merger, acquisition, restructuring, or sale of assets — in which case users will be notified before their PII is transferred; and
- (e) with your explicit consent.
We will never sell, rent, or lease your PII to third-party advertisers. We may, however, share non-identifiable aggregate or statistical data with advertisers or researchers.
8Security
We implement industry-standard technical and organisational safeguards to protect your PII from unauthorised access, loss, alteration, or disclosure. These measures include SSL/TLS encryption for data in transit, encrypted storage, firewalled servers, access controls, and regular security reviews.
Access to PII is restricted to employees, contractors, and agents with a genuine need to access it for their duties. Your account is protected by a password of your choosing (which we store in encrypted form). We strongly recommend that you do not share your password with anyone.
In the event of a security breach that affects your PII, we will notify you as required by the Digital Personal Data Protection Act, 2023 and any notified rules thereunder.
Despite these measures, no system is entirely immune to security risks. We cannot guarantee the absolute security of data transmitted over the internet. You transmit data to us at your own risk. The Company and its officers, directors, employees, and affiliates will not be liable for losses arising from any unauthorised breach of our security measures that occur despite our reasonable precautions.
9Cross-Border Data Transfers
Your PII may be stored and processed in India or in any other country where the Company or its Service Partners operate facilities, subject to any restrictions imposed by the Central Government under the Digital Personal Data Protection Act, 2023. By using the Platform, you consent to your information being transferred to countries whose data protection laws may differ from those of your home country. Where required, we implement appropriate transfer mechanisms to ensure that your data receives adequate protection.
10Accessing and Correcting Your Information
You may view and update most of your PII directly through your account settings. To request corrections, access, or deletion of your PII, please contact us:
Email: support@ownbeat.co
Post: Attn: Privacy Compliance Officer, 3rd Floor, JMD Regent Arcade, A-Block, DLF Phase-1, Sector-28, Gurugram, Haryana 122002, India
Please include your name and registered email address in all correspondence. We recommend keeping your PII up to date. Depending on your jurisdiction, you may have additional rights, including the right to data portability and the right to object to certain processing activities.
For users in the European Union, your rights include:
- (a) the right to access your PII and to obtain a description of how it is processed;
- (b) the right to withdraw consent to processing at any time (without affecting the lawfulness of earlier processing);
- (c) the right to correct inaccurate or incomplete PII;
- (d) the right to receive a copy of your PII in a portable, machine-readable format;
- (e) the right to request erasure of your PII in certain circumstances; and
- (f) the right to transfer your PII to another service provider where technically feasible.
11Your Rights Under Indian Data Protection Law
(I) Right to Withdraw Consent
You may withdraw your consent to our processing of your PII at any time by writing to our Consent Manager at support@ownbeat.co. We will act on your request within a reasonable period. Note that withdrawal does not affect the lawfulness of any processing that occurred before the withdrawal. If you withdraw consent, we may be required to close your account, and you will lose access to the Platform. We will, however, retain data that we are legally required to keep, including data needed to resolve disputes, comply with court orders or regulatory requirements, detect or prevent fraud, maintain platform integrity, and respond to third-party claims.
No consent is required for the Company to process PII in the following situations (though we may provide notice to users outside India, and will serve European users in the manner determined by the Company):
- (a) research, archiving, or statistical analysis where the data is not used to make decisions about a specific individual;
- (b) enforcement of legal rights or claims;
- (c) prevention, detection, investigation, or prosecution of any offence;
- (d) processing of data of users outside India under a contract with a person outside India;
- (e) processing in connection with a corporate restructuring, merger, demerger, or transfer of undertaking; or
- (f) ascertaining financial information about a person who has defaulted on a loan or other financial obligation, where such processing is permitted by applicable law.
(II) Right of Grievance Redressal
If you have a complaint about how we or our Consent Manager handle your PII, or about our compliance with the Digital Personal Data Protection Act, 2023, please email support@ownbeat.co with the details of your grievance. We will acknowledge and investigate your complaint in a timely manner.
(III) Right to Approach the Data Protection Board
After exhausting the grievance redressal process with us, you have the right to escalate your complaint to the Data Protection Board of India in accordance with the Digital Personal Data Protection Act, 2023 and any rules notified thereunder.
12Children’s Privacy
The Platform is intended for users who have attained the age of majority in their country of residence. We do not knowingly collect PII from minors. If you are a parent or guardian and believe that a minor in your care has submitted PII to us, please contact us at support@ownbeat.co so we can promptly delete the information. Where a minor’s PII is disclosed to us, the parent or guardian who has consented on the minor’s behalf accepts responsibility for ensuring compliance with this Policy and is bound by its terms.
13Public Areas and User Conduct
If you post or disclose PII — such as your name or email address — in any public area of the Platform (for example, a discussion forum), that information may be collected and used by other users or third parties. Such secondary use is beyond our control and is not governed by this Policy. Please exercise caution when sharing personal information in public areas.
